Job Posting and Recruitment Guidelines - Singapore
Recruitment Guidance - Singapore
About Recruitment Guidance
At Bossjob, we provide Recruitment Guidance to ensure that job seekers and recruiters can use the service safely and in compliance with Singaporean laws. When posting a job, recruiters are required to comply with key regulations and guidelines provided by the Ministry of Manpower (MOM) and Bossjob's terms of service. Even if certain conditions are not explicitly mentioned here, the content of job postings may still violate the law.
If a job posting contravenes MOM guidelines and regulations or violates our terms, Bossjob will notify you of the necessary changes.
Recruitment Guidelines to Ensure Compliance with Singapore Labour Regulations and Law
1. Non-Discriminatory Practices
All recruitment processes must follow Singapore’s Tripartite Guidelines on Fair Employment Practices. Employers should ensure fair and merit-based hiring, focusing on skills, experience, and qualifications. Discrimination on the basis of age, race, gender, religion, marital status, family responsibilities, or disability is strictly prohibited.
2. Job Advertisements
Job advertisements must clearly describe the requirements and responsibilities of the role. It is essential to avoid any discriminatory language or unnecessary restrictions (e.g., age limits or gender preferences). Ensure that all job postings align with the Fair Consideration Framework.
3. Foreign Worker Quotas and Work Passes
Singapore employers must comply with foreign worker quotas and work pass requirements. Ensure that you are familiar with the necessary work passes for hiring foreign employees (e.g., Employment Pass, S Pass, or Work Permit). Employers must submit work pass applications and check that all foreign hires have valid documentation.
4. Employment Contracts
A written employment contract must be provided to all employees, outlining their roles, salary, benefits, working hours, and leave entitlements, as required by the Employment Act. Ensure the contract is compliant with Singapore’s laws on minimum employment standards.
5. Workplace Health and Safety
Employers must ensure a safe and healthy working environment, as stipulated by the Workplace Safety and Health Act. Employees should be informed of all health and safety policies during the hiring process.
6. Personal Data Protection
Recruitment activities should comply with the Personal Data Protection Act (PDPA). Personal information collected during the hiring process must be managed securely and used only for the intended purpose of recruitment.
7. Fair Consideration Framework (FCF)
Before hiring foreign employees, employers must ensure that Singaporeans are given fair consideration for job opportunities. Advertisements must be placed on the MyCareersFuture website for at least 28 days before applying for an Employment Pass for foreign candidates, unless exempted.
8. Employment of Vulnerable Workers
Employers should ensure fair treatment of vulnerable groups, such as lower-wage workers, persons with disabilities, and older workers, and adhere to any relevant protections or wage regulations.
9. Equal Remuneration
Pay must be based on the work performed and employees’ qualifications, experience, and performance. Employers must ensure compliance with wage guidelines set out by MOM and industry-specific regulations.
10. Handling Complaints and Grievances
A clear and fair grievance handling procedure must be available for candidates and employees to report any unfair hiring practices. Employers should establish mechanisms to address these issues promptly and transparently.
Consequences of Violating Recruitment Guidelines
If your job posting violates these recruitment guidelines or applicable laws, Bossjob may reject the posting. You will be notified of any necessary changes by customer support. Failure to address the required revisions within the given timeframe may result in restricted access to the platform.
This guidance ensures recruitment practices align with the legal framework and ethical standards in Singapore. Please note that these recruitment guidelines are subject to updates in line with new legal developments and Bossjob's policies. Always review the latest version before submitting a job posting.
